Jefferson County Grand Jury indicts 28 (2024)

CHARLES TOWN – A list of indictments was handed up on Friday from the Jefferson County Grand Jury, including the names of 28 people who were charged with felonies in the county.

Included in the list was a group of five people who were all charged with organized retail theft. According to court documents, the group, which included Charles Jaques Elis, Gregory Keith Stottlemyer, Wade Preston Holmes, Marissa Huntoon Gregory and Haile Madalynn Speaks, stole more than $10,000 of merchandise from Home Depot in Ranson, with the intention of selling or trading it.

Also included was John Ester Berry, who was accused of child abuse creating serious risk of bodily injury or death after he kicked a child into an oncoming lane of traffic.

All of the people charged will be in court for arraignment in either late January or early February. More information will come out as it is released.

Charges included in the indictments are merely accusations and not evidence of guilt. Each defendant is presumed innocent until they are proven guilty.

Those indicted include:

• Donnell Lorenzo Babb, 33, of Washington D.C. was charged with domestic violence (3rd offense) and a misdemeanor charge of obstruction.

• Michael Earnest Marshall was charged with two counts of possession with intent to deliver heroin and methamphetamine.

• Levi Daniel Suttenfield, 44, of Kearneysville was charged with driving while license is revoked for DUI (3rd offense) and a misdemeanor charge of fleeing from a law enforcement officer on foot.

• Charles Jaques Elis was charged with organized retail theft over $10,000.

• Gregory Keith Stottlemyer, 36, of Charles Town was charged with organized retail theft over $10,000.

• Wade Preston Holmes, 38, of Charles Town was charged with organized retail theft over $10,000.

• Marissa Huntoon Gregory was charged with organized retail theft over $10,000.

• Halie Madalynn Speaks was charged with was charged with organized retail theft over $10,000.

• Adam Joseph Plauche, 43, of Harpers Ferry was charged with soliciting a minor via a computer and use of obscene matter with intent to seduce a minor.

• Teresa Jean Moler was charged with embezzlement.

• Bruce Lee McDonald was charged with failure to register as a sex offender.

• Esther Marcella Irving, 40, of Summit Point was charged with breaking and entering, destruction of property, petit larceny, driving while license is revoked for DUI and three counts of conspiracy.

• Robert Lee Irving, 39, of Summit Point was charged with breaking and entering, destruction of property, petit larceny, driving while license is revoked for DUI and three counts of conspiracy.

• Brandy Lea Dignazio, 27, of Charles Town was charged with fleeing from law enforcement with reckless indifference, felony conspiracy and fleeing from law enforcement on foot.

• Cameron G. Franklin, 53, of Ranson was charged with malicious assault, domestic assault and domestic battery.

• John Ester Berry was charged with two counts of child abuse creating substantial risk of serious bodily injury or death, child abuse causing bodily injury and domestic battery.

• Clarence Vaughn IV was charged with possession with intent to deliver a schedule II narcotic and a misdemeanor charge of possession of marijuana.

• Samuel Lee Wilson, 31, of Harpers Ferry was charged with driving under the influence causing serious bodily injury.

• Aaron Nathaniel Heinlein, 20, of Harpers Ferry was charged with two counts of burglary, two counts of grand larceny, felony destruction of property and a misdemeanor charge of destruction of property.

• Destiny Nicole Thompson was charged with two counts of sexual assault in the third degree.

• Jorge Luis Valdes, 44, of Kearneysville was charged with kidnapping, attempted murder in the first degree, assault during the commission of a felony, two counts of malicious assault and domestic battery.

• Stewart Allen Crank Jr. was charged with possession with intent to deliver marijuana.

• Henry Paul Dawson was charged with domestic battery (3rd offense) and violation of a protective order.

• Jessica Marie Buzzard was charged with delivery of a controlled substance resulting in death.

• Kit Michael Corbin was charged with use of a minor in filming sexually explicit conduct, soliciting a minor via a computer and two counts of use of obscene matter with intent to seduce a minor.

• Jeanie Marie Lilly was charged with uttering and felony conspiracy.

• David Burtte Over Jr. was charged with uttering and felony conspiracy.

• Daniel Theodore Whetzel was charged with DUI causing serious bodily injury, DUI (3rd offense), DUI causing bodily injury and driving while license is revoked for DUI.
